MGT5231 Week 7 - Chapter 10 – Construction and Chapter 12 – Government
I have posted the discussion question for this week. Please attempt to make your initial response early in the week so other students can make their replies.
The reading for this week is Chapter 10 – Construction and Chapter 12 – Government and the Contractor Labor Force. The first case to brief this week is National American Insurance Co. v. United States on page 435 of the text.
Explanatory information for NAICO: A surety bond creates a three party relationship where the surety (NAICO) makes sure payment is made for the principal’s (IPBX) liabilities to a third party (Wiltel). As a result, of that and upon notice to the payer (US) it is as if NAICO steps into the shoes of IPBX and has whatever rights IPBX had. Please note the discussion about the procedural issue of summary judgment is not the main issue of the case and it does not need to be discussed in your brief.
The second case to brief is Janik Paving & Construction, Inc. v. William E. Brock, III, as Secretary of the United States Department of Labor page 503
The briefs needs to be submitted and the discussion questions answered and a response made to another student’s posting in CANVAS by 11:59 pm ESDT, Sunday, July 19, 2015.
Thank you for your cooperation and have a good week.
