Until very recently the majority of jurisdictions in this country relied upon indeterminate sentencing, rather than structured sentencing .What assumptions about human behavior does the indeterminate model make? Incidentally, supporters of structured sentencing advance the argument that the indeterminate model failed due to demonstrable high rates of recidivism characteristic of those sentenced under it. Some critics of structured sentencing argue that the structured approach to criminal sentencing does little to promote rehabilitation. What might it be about the model that leads to such a charge?
