Britney saw a sweatshirt advertised for sale for $30 in an Eddie Bauer catalog that she received forty days ago. She sent a check for $30 with her order for that one sweatshirt. The company returned her check, saying the price had risen to $38. Britney claimed Eddie Bauer breached by not selling her the sweatshirt for $30. The catalog was the August edition and Britney attempted to purchase the sweatshirt after mid September. There was no statement anywhere in the catalog stating prices were fixed or guaranteed.

1.Was B right in her claim against Eddie Bauer? Why?

2.Was Eddie Bauer guilty of breach of contract? Explain fully providing any assumptions or facts you think are necessary to answer. Remember, the law does employ presumptions at times.

This revocation letter was lost in the mail so Bob never received it. June 5th, Bob decided to accept the offer and mailed Sam an acceptance. Sam got this letter on June 6th. Sam claimed no contract existed since he revoked his offer before B accepted.
