Exempt and Non-Exempt EmployeesIt is important to distinguish the difference between exempt and non-exempt employees according to the Fair Labor Standards Act (FLSA). Exempt employees are not paid overtime but non-exempt employees must be paid overtime. Employers are required to pay overtime for hourly jobs in order to comply with the FLSA. Employees in positions classified as salaried non-exempt are covered by the overtime provisions of the FLSA and therefore must be paid overtime.
