Rough Draft.Capital punishment is absolute, can the same be said about our justice system? Capital punishment, the death penalty has been a method of disciplinary action since early colonial days. The adolescent American colonies had adopted this method of punishment. Jamestown colony of Virginia had the pleasure of having the first recorded execution; Captain George Kendall was executed for being a spy of Spain. This taste of capital punishment flooded open the gates, Virginia Governor enacted Moral and Martial Laws, allowing the death penalty for minor crimes. Similar to our system today, laws related to the death penalty varied depending on the colony. A civilized nation can solve its criminal problems without taking an irreversible and an arguable inhumane step. Overview/ Explanation:Believed to be the highest form of corporal punishment, the death penalty, capital punishment, is to be used in very serve instances. Meanwhile, the death penalty was never ruled as a violation of the 8th amendment (a ban on cruel and unusual punishment), however this amendment provides the certain restrictions regarding the cases the jury may utilize the death penalty. During the analysis of the death penalty under the eighth amendment the courts had to not only consider the statute but also consider the changing perception of cruel and unusual. And with this the courts must come to a solution in not having restrictions, compromising both sides of the issue. Although, what is the American people founded or adopted a new solution, to not killing those who had committed a heinous crime but still severely punished those deserving. Public Opinion:Public opinion is constantly fluctuating according to Gallup Americas lowest support rating for the death penalty was in 1966, a below the bar number of 42%. Although in 1994 the support rating had peaked to its highest at 80%. And now, in present day the American people have slowing began to disapprove of the death penalty. 42% of Americans still show signs of disapproval, nonetheless, just below half of Americans are for capital punishment. What if we didn’t only look at America as a whole but broke it down? In the past decade the encouragement of the death penalty has been on a slow downward fall throughout each party. For instance, from 1996 to 2016 advoction for the DP decreased, republicans went from 87% to 72%, independents from 79% to 44%, and the democrats went from 71% to 34% all according to the pew research center. The numbers are falling support is collapsing, are we going to catch up and bend to the people’s needs? Isn’t that what the government is there for, too oblige the people?www.pewresearch.org/fact-tank/2016/09/29/support-for-death-penalty-lowest-in-more-than-four-decades/www.gallup.com/poll/14050/who-supports-death.aspxBackground:www.deathpenaltyinfo.org/part-i-history-death-penaltyDeath penalty originating in Britain, eighteenth century B.C., traced back to King Hammurabi of Babylon, who believed 25 different crimes deserved the consequence of the death penalty. Reason number three is questioning how those for the death penalty ca say its humane, “there’s no humane way to kill,” says the author. Similar to our system today, laws related to the death penalty varied depending on the colony. A civilized nation can solve its criminal problems without taking an irreversible and an arguable inhumane step. A court sanctioned punishment by death of very serious crimes. Following due process of the law one could be tried again to decide if they should be sentence to the death penalty. The death penalty is still active in 31 states, majority using the lethal injection the final course of death. In 2015 the united states had the smallest amount of executions since 1991, a total of 28, meanwhile 52 capital punishment crimes were imposed, also the lowest since the 1990s. As of January 2017, 1,44 people have been executed since 1976, the year the Supreme court reinstated the death penalty. This corporal punishment is an unnecessary resource, that the united states have been dependent on for too long, it’s an outdated institution and should be abandoned.www.deathpenaltyinfo.org/part-i-history-death-penaltywww.mashable.com/2015/03/11/history-of-american-death-penalty/#GY5u&II5_PqSwww.deathpenalty.procon.org/view.resource.php?resourceID=002000http://soapboxie.com/government/Advantages-and-Disadvantages-of-Capital-Pinishment-Death-Penaltywww.deathpenalty.procon.org/view.resource.php?resourceID=002000http://www.amnesty.org.au/5-reasons-abolish-death-penalty/***Late I know, yet I can still use your opinion.
