WEEK 7 DISCUSSION B

The last 20 years have seen serious labor disputes emerge between professional sports leagues and the unions that represent their players. Throughout these disputes, leagues and unions have used a variety of economic weapons provided under labor law. These economic weapons include the right to lock out players, which is held by team owners, and the right to strike, which is held by players. Watching these labor disputes in sports evolve, the question becomes: What is the best strategy for each side to execute in order to obtain what they want in collective bargaining?

Discussion B: Labor Law and the National Football Players Association Case

In 2011, NFL players employed a unique strategy in their collective bargaining negotiations with the NFL. When NFL owners locked players out, the National Football Players Association (NFLPA) immediately decertified its union and filed an antitrust lawsuit. Based upon the litigation that followed and what NFL players received in the most recent collective bargaining agreement, do you believe this was a good legal strategy? Why or why not?
