One way to organize your thoughts on IDEA/IDIEA issues and to prepare for educating colleagues in the nuances of the law is to make a list of the conflicts between these legal requirements and those of NCLB. Prepare a table with the issues below in the first column and potential ways to address the conflicts in practice in the second column. You may use short paragraphs and/or bulleted lists in the second column for your responses. Here are a few of the issues to consider (you may also add additional issues, based on your experiences with these policies):
- NCLB requirements may engender actions that are illegal under the IDEA.
- NCLB = evaluating subgroups; IDEA = evaluating the individual
- How can the IDEA principle of individualized education be applied to all students toward proficiency by the NCLB date of 2013-2014?
- The RTI Model may lead to legal issues if a referral is improperly held up. Remember, a parent referral must be honored.
- The IEP must be followed even if other students in a group are receiving different services.
- Measuring growth includes a broader framework, also assessing social and emotional needs.
