The Structure of the Legal System – Federalism

Course Outcomes:

LS100-1: Describe the foundation, organization, and structure of the American legal system.

LS100-2: Identify different sources of law and their role in the American legal system.

Assignment:

As described in Chapter 2, the American government follows the principle of federalism, in which both the federal government and state governments coexist and make laws within their own designated realms. In this assignment, you will have the opportunity to learn about federalism and the role played by the federal government and state governments in the lawmaking process.

Instructions:

Based on your reading of Chapter 2, write a 2–3-page substantive descriptive paper addressing the following questions:

Describe the organization and structure of the American legal system by discussing the three branches of the federal government and the three branches of state government. Also, describe different roles and powers of the federal and state governments under the U.S. Constitution.

Describe the Supremacy Clause and explain what happens when there is a direct conflict between federal and state law.

Required Criteria:

In addition to fulfilling the specifics of the Assignment, a successful paper must also meet the following criteria:

Paper should be written in APA format and follow APA Guidelines, 6th ed.

Length should be 2–3 pages and will include a title page and reference page, which are not included in the page count.

Double-spaced and in a 12-point font

Viewpoint and purpose should be clearly established and sustained

Assignment should follow the conventions of Standard American English (spelling, grammar, punctuation, etc.).

Writing should be well ordered, logical and unified, as well as original and insightful.

Your work should display superior content, organization, style, and mechanics.

The paper should include at least two citations cited using proper APA style. Source may include your textbook and/or other scholarly sources.

Submitting Your Work

Put your responses in a Microsoft Word document. Save it in a location and with the proper naming convention: username-Course Name-section-Unit x_Assignment.doc (username is your username, section is your course section, x is your Unit number). When you are ready to submit, select the unit Dropbox.

To view your graded work, come back to the Dropbox or go to the Gradebook after your instructor has evaluated it. Make sure that you save a copy of your submitted work.
