- Matt runs a jewellery wholesale business from a small factory in Balmain. He contracted Safety Control Pty Ltd on Tuesday and informed the manager that he needed an anti-theft grille replaced on the window on the eastern side of the factory before dark that night. The manager of Safety Control agreed to replace the grille and organised for an employee to go out to the factory.However the employee had a flat tyre and by the time it got fixed it was 6PM and the employee decided to go home. That night the factory was burgled and $20,000 worth of jewellery stolen. Discuss the issue of damages and any evidential matters that may be relevant.
