- After reading the case on pages 8 & 9 of the text, summarize (brief) the key
facts of the case. There is an example of a case brief on page 8 immediately
above the case. The brief refers to case 1.1 on the preceding page.
The summary of a legal case is called a ‘Case Brief” or simply a “brief,” and it
should follow a specific format.

 The first question asks you to prepare a “Case Brief” for Case 1.2: cThere is a sample “brief” of Case 1.1 on p. 8. That is a good example and it shows the correct format. We’ll be u

sing the same format each week, so it’s worth the time to become familiar with it. For the Unit 1 assignment, here’s an outline that works, along with some comments:
Name of case: The name of the case is given in the textbook.
Court: Use the name of the court that had the final decision in the case.Citation: The citation is given in the case in the textbook.

Parties and their roles: There are usually two parties each case. Identify them and indicate which party is the plaintiff and which is the defendant.Facts: The facts are covered in the case in the textbook. Summarize the relevant facts in your own words, using citations to the case as needed.Issues: The issues are also identified in the textbook. As with the facts, summarize the relevant issues in your own words, using citations and references as needed.District Court decision: Briefly summarize the decision of the District Court.Court of Appeals decision:

Briefly summarize the decision of the Court of Appeals.Supreme Court decision: Briefly summarize the final decision of the Supreme Court.Reasoning: This is the only part of the brief that is likely to exceed two or three sentences. Summarize the reasoning of the court that had the final decision in the case, and explain why they reached the verdict that they did. In Unit 1, you will be describing the reasoning of the Supreme Court, as written by Justice Souter. 2) Discuss the applicable law and legal issues in the case.This is the same as the Issues section from the Case Brief in Q1, but with additional detail. Identify the law that the defendant is accused of violating and look at the issues that may be relevant in the decision of the court. One of the possible issues in the assigned case is the fact that it is legal to loan or give a piece of music to a friend, or share portions of a copyrighted work for educational purposes. The name of that legal issue is “fair use.” The other legal issue is described in the case. 3) Why did the court find against Grokster.This is the same as the Reasoning section from the Case Brief in Q1. Explain why the Supreme Court reversed the lower courts and find Grokster guilty. Go into a little more detail than in the Reasoning section of Q1.4) Assume you are the CEO of Grokster. What could you do to be compliant with copyright laws?The prior questions should have identified what Grokster was doing to receive the guilty verdict. This question asks what it would take to make a service like Grokster’s legal. Use citations and references whenever possible to connect your recommendations to relevant material in the textbook. 600-800 word countthe only references that can be used is the attachements in this email.
